1. License Grant

Subject to these Terms and your payment of the applicable fee, we grant you a perpetual, non-exclusive, non-transferable license to download, install, and use the App on any Mac computers that you own or control, for your personal or internal business purposes.

This license is for your individual use. You may not distribute, sublicense, rent, lease, or lend the App to third parties.

2. Usage Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Distribute, sell, resell, or transfer the App to third parties
• Use the App for any illegal or unauthorized purpose
• Remove any proprietary notices or labels from the App

3. Purchase and Payment

3.1 Pricing

The App is available for a one-time purchase of $20.00 USD. This is a lifetime license with no recurring fees or subscriptions.

3.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and authorize the charge to your payment method.

3.3 Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with the App for any reason, contact us within 30 days of purchase at hello@floatie.app for a full refund.

4. Delivery

After successful payment, you will receive immediate access to download the App. The download link will be displayed on the confirmation page and sent to your email address.

5. Updates

Your license includes access to all future updates and improvements to the App at no additional cost. Updates may be delivered through the App's built-in update mechanism or via download from our website.

6. System Requirements

The App requires macOS 10.15 (Catalina) or later. It is provided as a Universal Binary that runs natively on both Intel and Apple Silicon Macs. We do not guarantee compatibility with future macOS versions, though we will make reasonable efforts to maintain compatibility.

7. Intellectual Property

The App and all related intellectual property rights remain the exclusive property of Floatie. These Terms do not grant you any rights to our trademarks, service marks, or logos. All rights not expressly granted in these Terms are reserved.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLOATIE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP ($20.00 USD).

10. Indemnification

You agree to indemnify and hold Floatie harmless from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
